Terms of service

1. The service

Kinético (kinetico.video) is an online tool that generates motion graphics videos with artificial intelligence from a description and, optionally, the user's own material (voice, images and their product URL). It is provided by [titular pendiente] (tax ID [NIF pendiente]).

By creating an account or using the service you accept these terms. If you do not agree, do not use the service.

2. Account

You need an account (email and password, Google or Apple) to create videos. You must be over 16, provide accurate details and keep your access secure. You are responsible for what is done with your account.

Only one account per person may be used to claim the free video. We may suspend accounts created to abuse it.

3. Free video

Every new account includes 1 free video with the Basic plan limits and a reduced number of changes. If the generation fails, the credit is returned automatically. After that, a subscription is required to keep creating videos.

4. Plans, prices and payment

There are two monthly plans: Basic (€49/month) and Pro (€99/month), taxes included where applicable. What each plan includes (videos per month, formats, length, changes per video and downloads) is detailed on the pricing page.

Payments are processed by Stripe. We do not store your card details. The subscription renews automatically every month on the same date until you cancel it. Unused videos do not roll over.

If a payment fails, Stripe will retry it for a few days; if it still fails, the subscription is cancelled and you lose access to creating new videos.

We may change prices with at least 30 days' notice; the new price applies from the next renewal and you can cancel before then if it does not suit you.

5. Cancellation and right of withdrawal

You can cancel at any time from the Studio (manage subscription). Cancellation takes effect at the end of the period already paid; until then you can keep using your plan. Partial periods are not refunded.

Kinético is digital content supplied immediately. By subscribing you expressly request that the service starts right away and acknowledge that, once started, you lose the 14-day right of withdrawal. If you have not generated any video in the period yet, contact us within 14 days of payment and we will refund you.

6. Fair use

Plans are designed for normal professional use. To keep the service available for everyone, we may temporarily limit generation for an account whose use of changes and fixes clearly exceeds the usual, or pause generation globally during demand peaks. We will tell you in the Studio.

7. Your material and your videos

You keep all rights to the material you upload. You grant us a limited licence to store and process it solely to generate and show you your videos.

You may use the videos you generate with your account for any purpose, including commercial use, while your account is in good standing. Videos are created with AI: other users may get similar results and we do not guarantee that a result is unique or that it can be registered as your own work.

You must have the right to use everything you upload (voices, logos, images, trademarks) and you may not generate content that is illegal, defamatory, infringes third-party rights, impersonates others or is misleading. We may remove content and suspend accounts that break these rules.

8. Availability and liability

We work to keep the service running continuously, but there may be interruptions for maintenance or reasons beyond our control. Review every video before publishing it: AI results may contain mistakes.

Except for wilful misconduct or gross negligence, and to the extent permitted by law, our liability is limited to the amount you paid in the last 12 months. Nothing here limits your statutory consumer rights.

9. Changes and closing your account

We may update these terms; if a change is material we will notify you by email in advance. You can close your account at any time by writing to soporte@kinetico.video.

10. Governing law and complaints

These terms are governed by Spanish law. For any question or complaint write to soporte@kinetico.video. If you are a consumer, you may bring proceedings in the courts of your place of residence and contact your local consumer authorities.
